By accessing or using Carbirdy, you agree to these Terms of Use. Carbirdy provides an online platform where private owners and dealers can advertise vehicles and communicate with prospective buyers.
Carbirdy’s role
Carbirdy provides a vehicle-listing and communication platform. Carbirdy is not the owner, seller, dealer, buyer, inspector, lender, transporter, or payment intermediary for vehicles advertised by users unless expressly stated otherwise.
Vehicle transactions are arranged directly between buyers and sellers.
Seller responsibilities
Sellers must provide accurate information about themselves and the vehicles they list. Sellers must have the legal right to advertise the vehicle and must not knowingly provide false, misleading, or materially incomplete information.
Sellers should accurately disclose the asking price, mileage, vehicle condition, title status, known liens, and other material information requested by Carbirdy.
Private sellers must not misrepresent themselves as dealers, and dealers must not misrepresent themselves as private owners.
Buyer responsibilities
Buyers are responsible for independently evaluating vehicles before purchasing them. Buyers should inspect the vehicle, verify ownership and title information, review available vehicle-history information, confirm the seller’s identity, and use appropriate caution before transferring money.
Carbirdy does not guarantee the accuracy of information supplied by sellers.
Prohibited activity
Users may not use Carbirdy to advertise stolen vehicles, fraudulent listings, vehicles they are not authorized to sell, misleading pricing, illegal products or services, or content intended to deceive, harass, spam, or harm other users.
Users may not attempt to interfere with Carbirdy’s systems, create accounts to evade restrictions, impersonate another person or business, or misuse the messaging system.
Listing review and removal
Carbirdy may review, reject, suspend, edit, or remove listings or accounts when reasonably necessary to enforce platform rules, address suspected fraud or abuse, comply with legal obligations, or protect users and the platform.
Publication of a listing does not mean that Carbirdy has verified the seller, vehicle ownership, vehicle condition, title, mileage, financing status, or accuracy of the advertisement.
Messaging and communications
Carbirdy may provide tools that allow buyers and sellers to communicate. Users are responsible for the content of their communications and should not send sensitive information such as passwords or complete payment-card details through marketplace messages.
Fees and paid services
Carbirdy may offer paid listings, promotions, dealer plans, or other paid services. Any applicable price, listing duration, renewal terms, and refund conditions will be disclosed before purchase.
Paid placement does not constitute verification, endorsement, or certification by Carbirdy.
No guarantee of sale
Paying for or publishing a listing does not guarantee views, inquiries, offers, or the sale of a vehicle.
Third-party services
Carbirdy may use or link to third-party services such as maps, payment processors, vehicle-information providers, or external websites. Those services may have their own terms and privacy practices.
Limitation of responsibility
To the extent permitted by applicable law, Carbirdy is not responsible for disputes, losses, damages, misrepresentations, payment problems, vehicle defects, title issues, accidents, or other problems arising from transactions or communications between users.
Nothing in these Terms excludes rights or protections that cannot legally be excluded.
Changes to these Terms
Carbirdy may update these Terms as the platform develops. Updated Terms will be posted on this page with a revised “Last updated” date.
